This terms and conditions of this Policy are incorporated into the Coast9 Terms of Service Agreement.
Disclosures Made as Necessitated by Law or Safety
Your name, physical address, phone number, password and other personal information provided to us are considered confidential. We value your privacy, and information you supply to the Site will not, except in very limited circumstances, be shared with third parties for any reason. We will supply your information if necessary to comply with applicable law and/or to cooperate with law enforcement. Your information may also be shared in order to comply with a request or order by a judiciary authority.
Information We May Collect From You During Sign Up
We require that you provide us with certain information which may include Account Data (i.e., your name, physical address, email address, phone number, username, and password), along with “Demographic Information”. Demographic Information may include IP address(es), referring website information, Internet browser used, zip code and/or other data regarding search history, browsing history, registration and user history.
Data From Social Media Accounts
To use the Services, you will be required to authenticate your account with certain online third party services, such as Facebook, Twitter, Instagram, and others (“Social Media Services”). By logging in or directly integrating these Social Media Services into the Services, Coast9 can capture the Social Media Information needed to track and report metrics on social media accounts that we enable users to view. In order to enable this functionality, we will ask you to authenticate accounts for Social Media Services on the websites of their respective providers. You will provide your login information, like your password, directly to such Social Media Services, not to Coast9. As part of such integration, Social Media Services will provide us with access to certain information that you have provided to such Social Media Services, and we will use, store and disclose such information in accordance with the Retention Period listed in this policy. The manner in which Social Media Services use, store and disclose your information is governed solely by the policies of such third parties, and Coast9 shall have no liability or responsibility for the privacy practices or other actions of any third party site or Services that may be enabled within the Services. In addition, Coast9 is not responsible for the accuracy, availability or reliability of any information, data, content, goods, opinions, advice or statements made available in connection with Social Media Services. As such, Coast9 is not liable for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such Social Media Services (or Coast9's interpretation of such data). The integration or inclusion of such features does not imply an endorsement or recommendation of any particular Social Media Services.
Use of Information
Financial Data will only be shared with third party processors as necessary to initiate and complete any orders placed by your account. We may use “cookies” and Demographic Information to better your experience on the Site by allowing us to tailor your experience on the Site according to your preferences and what we think may appeal to you based on such Demographic Information. Aggregate, non-individual membership Demographic Information may be shared with third parties with whom we have a direct or indirect relationship who may offer products or services we believe you may be interested in. We may also share the aggregate Demographic Information with third parties for the purposes of analyzing usage data, maintaining servers and other purposes relating to maintaining and improving our service and the Site.
You Are Responsible For Information You Provide to Third Parties
Emails From Us and Use of Your Email Address
Your email address will be used by us to contact you or in the event that we have special offers or other information to provide you. Such information may include, without limitation, new services offered by us, information relating to your account and other information related to your subscription to the Site. We may send you emails prior to and after you have terminated your membership to our service until such time as you advise us, in accordance with the procedures explained below, that you no longer wish to receive email from us. If you no longer wish to receive emails from us please unsubscribe by sending us an email to firstname.lastname@example.org. We fully comply with the federal CAN-SPAM Act and as such all emails from us will always, among other required disclosures, have means for you to opt out of receipt of further email correspondence. Please note we will never send you an email directly or through any marketing partners without your consent. Please immediately report any emails you may receive, without your prior authorization, which purport to promote the Site.
Changes in the Ownership of the Site
The Site is a growing online service. As such, we may have the occasion to buy or sell assets, including but not limited to merger, dissolution, and transfer of ownership. Depending upon the nature of any transaction, we may share any and all data provided by you to us (including Financial Data and Account Information) with third parties, as necessary to initiate, investigate or complete any such transaction(s).
Children’s Privacy. The Site is not directed toward individuals under the age of 18, and we do not knowingly collect any personally identifiable information online from individuals under the age of 18. Our Terms of Service prohibit individuals under the age of 18 from registering or otherwise participating in our Site (unless, in certain cases, specific usage is approved by a signatory - parent or guardian over the age of 18 - on behalf of an individual under the age of 18).
Security. We seek to have security measures and tools, such as firewalls, in place to help protect against the loss, misuse and alteration of the information under our control. Unfortunately, no data transmission over the Internet or data storage system can be guaranteed to be 100% secure. As a result, although we strive to protect personally identifiable information about you, we cannot ensure or warrant the security of any information you transmit to us through or in connection with the Site or that is stored by us. You acknowledge and agree that any information you transmit through the Site or upload for storage in connection with the Site is so transmitted or stored at your own risk. If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of any account you might have with us has been compromised), you must immediately notify us of the problem by contacting us below (note that if you choose to notify us via physical mail, this will delay the time it takes for us to respond to the problem).
California Privacy Rights. Individual customers who reside in California and have provided their personal information to Coast9 may request information about its disclosures of personally identifiable information to third parties for their direct marketing purposes. Such requests should be submitted to email@example.com. Within thirty days of receiving such a request, we will provide a list of the categories of personal information disclosed by Coast9 to third parties for the third parties’ direct marketing purposes during the immediately preceding calendar year, along with the names and addresses of these third parties. This type of request may be made no more than once per calendar year. Coast9 reserves its right not to respond to requests submitted other than to the email or physical addresses specified in this paragraph.
Changing or Updating PII. If you would like to review, correct, or update the personally identifiable information about you that has been previously provided to us through the Site, you may access your personally identifiable information through the “My Account” link at the top of the Site. We will endeavor to comply with your request as soon as reasonably practicable. We may need to retain certain information for recordkeeping purposes, and there may also be residual information that will remain within our databases and other records, which will not be removed. Finally, we are not responsible for removing or suppressing information from the databases of third parties with whom we have already shared personally identifiable information about you, or limiting their use of personally identifiable information about you.
Retention Period. We will retain personally identifiable information about you for the period necessary to fulfill the purposes outlined in this Policy unless a longer retention period is required by law and/or regulations.
Jurisdictional Issues. Coast9 does not represent or warrant that the Site, or any part thereof, is appropriate or available for use in any particular jurisdiction. Those who choose to access the Site do so on their own initiative and at their own risk, and are responsible for complying with all local laws, rules and regulations. We may limit the Site’s availability, in whole or in part, to any person, geographic area or jurisdiction we choose, at any time and in our sole discretion. By using the Site and submitting any personally identifiable information, you consent to the transfer of personally identifiable information to other countries, such as the United States, which may provide a different level of data security than in your country of residence.
